TERMS OF SERVICE
Effective date: August 18, 2026
These terms govern your use of rougemedia.net (the “Site”) and the services of Rouge Media Productions (“Rouge Media”, “we”, “us”), a video production and creative studio based in Etobicoke, Ontario, Canada. By using the Site, creating an account, or booking services, you agree to them.
1. Service agreements come first
Production shoots and monthly plans are each governed by a specific agreement you review and sign electronically before payment — a Shoot Production Agreement for one-off shoots, or a subscription agreement for monthly plans. If anything in these terms conflicts with an agreement you signed, the signed agreement governs for that engagement. These terms fill the gaps and govern use of the Site itself.
2. Bookings, deposits, and cancellation
- A booking is confirmed when your deposit (or full payment, where you choose that option) is received.
- Deposits are non-refundable if you cancel a shoot, for any reason. They secure your date and our crew.
- You may request to reschedule at no charge with at least 48 hours’ notice, subject to our availability.
- If we must cancel or reschedule (weather, illness, equipment failure, or other circumstances beyond our reasonable control), you will be offered a new date or a full refund of any amount paid.
- Any remaining balance is invoiced after booking approval and is due on the terms stated in your agreement or invoice.
3. Monthly plans
Monthly plans renew each month until cancelled under the terms of the signed subscription agreement. Where a plan is billed on activation, nothing is charged until your work goes live.
4. Payments
Payments are processed by Stripe. Prices are in Canadian dollars unless stated otherwise. Late balances may accrue the late fee stated in your agreement.
5. Intellectual property
Unless your signed agreement says otherwise: Rouge Media retains copyright in the final deliverables, and on full payment you receive a perpetual, worldwide license to use, reproduce, publish, and distribute them for your own business and marketing purposes. Raw footage and project files remain ours unless agreed in writing. We may show completed work in our portfolio and marketing unless you designate a project confidential in writing before the shoot. All Site content — including the Rouge Media name, logo, and imagery — belongs to us or our licensors and may not be reused without permission.
6. Your account
You are responsible for keeping your account credentials confidential and for activity under your account. Provide accurate information; we may suspend accounts used fraudulently or abusively.
7. Acceptable use
Do not misuse the Site: no unauthorized access attempts, no scraping of private areas, no submitting content that is unlawful or infringes others’ rights. We reserve the right to decline to film, edit, or publish content we reasonably believe to be false, misleading, unlawful, or unsafe.
8. Disclaimers and liability
The Site is provided “as is”. To the maximum extent permitted by law, neither party is liable for indirect, special, or consequential damages, and our total liability for any engagement will not exceed the fees you paid for that engagement. Nothing in these terms limits liability that cannot be limited under applicable law.
9. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Disputes will first be addressed through good-faith negotiation.
10. Changes
We may update these terms from time to time; the current version will always be posted here with its effective date. Changes do not retroactively alter agreements already signed.
